An Overview of Diversionary Programs in New Jersey

New Jersey courtrooms have the discretion to sentence some criminal offenders to diversionary programs rather than jail. Among the most common diversionary programs in the state are the veteran’s diversion program, conditional discharge, and pre-trial intervention.

Veteran’s programs are meant for individuals who have served in our military and now suffer mental health conditions like PTSD. If they’ve committed a non-violent minor crime, then they may be able to submit to rehabilitation treatment rather than jail time. By choosing the rehabilitation program, the veteran’s charges will be dismissed.

Conditional discharge is only available to first-time offenders who are charged with a minor drug-related crime. Instead of going to jail, you’ll be released on a probation term that could last anywhere from one to three years. During that time, you’ll be subject to random drug testing. If you complete the program, then your charges will get dismissed.

Pre-trial intervention is similar to conditional discharge. If you’re accepted in the program, then you’ll be ordered to serve out a probation period. You may be eligible if you committed a third- or fourth-degree crime as a first-time offender. You also must not have any type of criminal charge within the past five years. You’re not eligible to apply if you’ve ever completed any type of diversionary program over your lifetime.
